Terms of Service

Effective date: June 2, 2026. These Terms govern access to and use of the Bar Goggles platform, mobile application, website, streaming services, camera systems, and related products and services operated by Bargoggles LLC, a Florida limited liability company ("Bar Goggles," "we," "us," or "our"). By accessing or using any part of the platform, you agree to these Terms. If you do not agree, do not use the platform.

1. Eligibility and Age

You must be at least 18 years old — or the legal drinking age in your jurisdiction, whichever is higher — to use the platform. By using it, you represent and warrant that you meet this requirement and are legally permitted to use a service featuring bars, alcohol, and related venues.

2. Platform Description; Informational Use

Bar Goggles is a live-streaming and venue-discovery platform that lets users preview participating venues, crowd activity, entertainment, specials, and related venue content through live video streams and related media. Live camera feeds, venue details, chat, reviews, hours, specials, and other content may be incomplete, delayed, inaccurate, interrupted, or unavailable at any time. Bar Goggles does not guarantee the safety, legality, quality, staffing, crowd behavior, capacity, or suitability of any venue or livestream. Do not rely on the platform as a substitute for your own judgment, verification, and safety precautions.

3. No Control Over Venues

Bar Goggles does not own, control, supervise, operate, or staff the bars, venues, patrons, employees, performers, cameras, or events shown on the platform. Participating venues are independent third parties responsible for their own premises, conduct, alcohol service, pricing, promotions, safety conditions, and compliance with law.

4. Your Responsibility

You are solely responsible for your own decisions, conduct, safety, travel, alcohol consumption, purchases, and interactions with other people, and for your attendance at any venue you choose to visit. You agree to drink responsibly, obey applicable laws, and never drive while impaired.

5. User Content

Chat messages, reviews, and other content you submit ("User Content") reflect the views of the individual who posted them, not Bar Goggles. You are responsible for your User Content and must not post unlawful, infringing, harassing, abusive, or deceptive material. You grant Bargoggles LLC a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your User Content within the platform and for operating and promoting the service. We may remove content and suspend or terminate users who violate these Terms.

6. Intellectual Property

Live feeds, videos, still images, audio, software, branding, logos, interfaces, graphics, and other proprietary materials made available through Bar Goggles are protected and are owned by or licensed to Bargoggles LLC and participating rights holders. You may not reproduce, redistribute, sell, scrape, record, screen-capture, reverse engineer, or commercially exploit any Bar Goggles content or systems without our prior written permission. Screenshots, screen recordings, and unauthorized sharing of live feeds are prohibited.

7. Acceptable Use

You agree not to: use the platform for unlawful purposes; harass venues, staff, or other users; attempt unauthorized access to systems or camera feeds; upload malicious code; or interfere with the operation of the platform.

8. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BARGOGGLES LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INJURY, LOSS, DAMAGE, DISPUTE, CRIME, OFFENSIVE CONDUCT, PROPERTY DAMAGE, PERSONAL INJURY, DEATH, OR INTOXICATION-RELATED INCIDENT ARISING FROM OR CONNECTED TO ANY BAR, VENUE, LIVESTREAM, USER INTERACTION, OR YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless Bargoggles LLC and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the platform, your User Content, or your violation of these Terms or applicable law.

11. Changes to the Platform and these Terms

We may modify, suspend, or discontinue the platform or any feature at any time. We may also update these Terms; when we do, we will update the effective date and may require acceptance of the revised Terms. Your continued use after an update constitutes acceptance.

12. Termination

We may suspend or terminate your access to the platform at any time, with or without notice, for conduct we believe violates these Terms or harms other users, venues, or Bar Goggles.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Nothing in these Terms deprives you of the protection of any mandatory, non-waivable consumer-protection laws of your state of residence.

14. Dispute Resolution; Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

(a) Informal resolution. Before starting an arbitration or lawsuit, you agree to contact us at support@bargogglesapp.com and attempt to resolve the dispute informally for at least 30 days.

(b) Binding arbitration. Except for small-claims matters and requests for injunctive relief to protect intellectual property, any dispute arising out of or relating to these Terms or the platform will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the county where you live or by telephone or video, and AAA rules govern the allocation of fees.

(c) Class-action waiver. YOU AND BARGOGGLES LLC AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND EACH WAIVES THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

(d) 30-day opt-out. You may opt out of this arbitration agreement within 30 days after first accepting these Terms by emailing support@bargogglesapp.com with your name and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

(e) Court matters. For any dispute not subject to arbitration, the exclusive venue is the state or federal courts located in Florida, and you consent to their personal jurisdiction.

15. Apple App Store Terms

If you use the Bar Goggles iOS application, this Agreement is between you and Bargoggles LLC only, not with Apple Inc. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it, including product-liability, legal or regulatory, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

16. Privacy

Use of the platform is also governed by the Bar Goggles Privacy Policy.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
